Secondary Condition Claim · VASRD 5000
A condition caused or aggravated by an already service-connected disability can be granted its own service connection as a secondary condition under 38 CFR § 3.310. Here's how that works for Osteomyelitis when it develops after Dermatophytosis (e.g. athlete’s foot, ringworm).
Primary condition · VASRD 7813
Dermatophytosis (e.g. athlete’s foot, ringworm)
Fungal skin infections affecting feet, nails, groin, or body.
Secondary condition · VASRD 5000
Osteomyelitis
Osteomyelitis is infection of bone — usually reaching it through an open fracture, a penetrating wound, surgery or the bloodstream — which can smoulder for years, produce dead bone (sequestrum) and drain through a sinus tract to the skin. DC 5000 rates it on how active and how widespread the infection is, and on how recently there has been objective evidence of activity.
The VA rates Osteomyelitis the same way whether it's claimed directly or as secondary to Dermatophytosis (e.g. athlete’s foot, ringworm) — severity of Osteomyelitis itself determines the percentage.
| Rating | Criteria |
|---|---|
| 100% | Infection of the pelvis or spine, or spread into major joints or several sites, or continuous whole-body symptoms |
| 60% | Repeated flare-ups that make you systemically ill |
| 30% | Imaging or surgery shows dead bone or new bone walling it off |
| 20% | A draining sinus or other proof of active infection in the last five years, in recurrent disease |
| 10% | Quiet for five years but with a history of repeated episodes |
Example combined rating
10% Dermatophytosis (e.g. athlete’s foot, ringworm) + 30% Osteomyelitis = 37%
The VA combines ratings with Table I of 38 CFR 4.25, not simple addition — 10% and 30% combine to 37%, not 40%. These figures are illustrative; your actual rating for each condition depends on your own evaluation.
